§ 524.3-1201 — Collection of Personal Property by Affidavit

Plain-Language Summary

If a person dies in Minnesota and their total estate is worth $75,000 or less (after subtracting debts), their heirs can collect the property without going through probate. The heir simply presents a death certificate and a signed affidavit to the bank, employer, or whoever holds the property.

Practical Notes
When this applies: When someone dies with a small estate (probate assets worth $75,000 or less after liens). Who this affects: Heirs of people who died with modest estates. Key points: This is the simplest way to transfer property after death, avoiding the cost and delay of probate. You must wait at least 30 days after death. No personal representative needs to be appointed. The affidavit must state the estate value is under $75,000, 30 days have passed, and no probate petition has been filed. This also works for transferring car titles and accessing safe deposit boxes.
