§ 540.08 — Injury to Child or Ward; Suit by Parent or Guardian

Plain-Language Summary

A parent or guardian can file a lawsuit when a minor child or ward is injured. If no parent sues, a guardian ad litem can bring the case. Before a parent receives any money from the lawsuit, they must post a bond or the court may order the funds invested in safe accounts until the child reaches adulthood. No settlement is valid without court approval.

Practical Notes
This law protects injured children’s financial interests. Courts must approve all settlements involving minors, and money awarded is typically held in protected accounts until released by the court. Parents cannot simply collect and spend injury awards meant for their children.
