§ 542.16 — Notice to Remove

This section gives any party in a district court case the right to remove the assigned judge once without giving a reason. After the first removal, you can only remove a substitute judge by showing actual bias or prejudice.

Practical Notes
You have one free chance to replace the judge assigned to your case by filing a notice to remove within 10 days of learning which judge is assigned. After that, you must prove actual prejudice to get a different judge.
