§ 548.251 — Collateral Source Calculations

After a jury awards damages in a personal injury or other civil case, the court must reduce the award by the amount the plaintiff already received from insurance, workers' compensation, or other 'collateral sources.' The jury is not told about these other payments. The reduction is offset by any premiums the plaintiff paid for that coverage.

Practical Notes
This affects the final amount you collect after winning a lawsuit. If your health insurance already paid your medical bills, the court will subtract those payments from your judgment. However, you get credit for premiums you paid for the insurance. The collateral source reduction happens before any reduction for comparative fault. Attorney fees are calculated on the reduced amount. Note: This does not apply to life insurance, Social Security, or private disability insurance you paid for entirely yourself.
