§ 571.913 — Effect of Exemption Notice

Plain-Language Summary

Sets the timeline for the bank account garnishment exemption process. The bank must mail the exemption notice to the debtor within 2 business days. The debtor then has 14 days to claim exemptions. If the debtor claims an exemption, the bank must release the exempt funds within 6 business days unless the creditor objects.

Practical Notes
Time is critical when your bank account is frozen. You have 14 days from the date the exemption notice is mailed to file your claim. Include copies of your bank statements for the prior 60 days with the exemption notice sent to the creditor. Even if you miss the 14-day deadline, failing to file does not permanently waive your exemption rights, but it makes recovery harder.
