§ 588.03 — Summary Punishment
Plain-Language Summary
When contempt of court happens right in front of the judge (direct contempt), the judge may punish it immediately without a separate hearing. The judge issues an order describing what happened and stating the punishment.
588.03 SUMMARY PUNISHMENT.
A direct contempt may be punished summarily, for which an order shall be made reciting the facts as occurring in the immediate view and presence of the court or officer, and adjudging the person proceeded against to be guilty of a contempt, and that the person be punished as therein specified.

Who this affects: Anyone present in the courtroom whose behavior constitutes direct contempt. Key points: Summary punishment means the judge can act immediately without a full hearing; the judge must issue a written order describing the contemptuous conduct and the punishment; this applies only to direct contempt that the judge personally witnessed; constructive contempt (disobeying orders outside of court) requires a different procedure under section 588.04.
