§ 609.1015 — Corporate Offenders; Penalty Assessment Required

Plain-Language Summary

Requires courts to impose a financial assessment on corporations convicted of crimes. The assessment can be up to $1,000,000 for felonies, $250,000 for gross misdemeanors, and $100,000 for misdemeanors. This is in addition to any other fines or restitution.

Practical Notes
The minimum assessment is 30% of the maximum unless the corporation proves undue hardship. The court cannot waive the assessment entirely. The assessment amount is based on factors like the seriousness of the offense, the corporation’s financial situation, and harm to victims. Funds go to the Minnesota victims of crime account.
