§ 609.2114 — Criminal Vehicular Operation; Unborn Child

Plain-Language Summary

Makes it a crime to cause the death of or injury to an unborn child while driving in a grossly negligent or impaired manner (including under the influence of alcohol, a controlled substance, or cannabis, or with an alcohol concentration of 0.08 or more, or by leaving the scene). Causing the death of an unborn child carries up to 10 years and a fine of up to $20,000, increasing to 15 years when certain impaired-driving violations occur within ten years of a qualified prior driving offense. Causing great bodily harm to an unborn child who is subsequently born alive carries up to 5 years and a fine of up to $10,000. A conviction under this section does not bar punishment for other crimes arising from the same conduct, and there is an affirmative defense for use of a controlled substance under a valid prescription.

Practical Notes
This section mirrors the criminal vehicular operation laws but applies specifically to harm to an unborn child. The same aggravating factors apply: driving under the influence, having an alcohol concentration of 0.08 or more, or leaving the scene. The injury offense in subdivision 2 requires that the unborn child be subsequently born alive. A conviction here can be punished in addition to other crimes committed as part of the same conduct.
