§ 609.542 — Illegal Remunerations

Makes it a crime to give or receive kickbacks or other things of value in connection with services paid for by a federal health care program, a behavioral health program under chapter 254B, or a program under chapter 142E. Covered acts include paying or receiving value to induce patient referrals, the purchase or ordering of covered goods or services, or applying for or receiving such items. Penalties scale with the value involved: up to 5 years and a $10,000 fine if the value is $5,000 or less, up to 10 years and a $20,000 fine if it is more than $5,000 but not more than $35,000, and up to 20 years and a $100,000 fine if it exceeds $35,000. Values within a six-month period may be aggregated, and certain federal safe-harbor payments and bona fide employment arrangements are exempt.

Practical Notes
This is a felony-level anti-kickback statute, not a gross misdemeanor, with penalties tied to the dollar value involved. A claim that includes items or services resulting from a violation also counts as a false or fraudulent claim under Minnesota’s False Claims Act (section 15C.02).
