§ 611A.06 — Right to Notices; Release; End of Confinement Review Process; Expungement; Escape

Plain-Language Summary

This section gives crime victims who submit a written request the right to be notified about key events involving the offender. Notices cover the offender's release or reduced custody status (60 days before release for a felony against the person with a sentence over 18 months), an expungement being sought, the end-of-confinement review process, an escape (within six hours of discovery and again within 24 hours of recapture), and the offender's submission of an apology letter (within 90 days of filing). The corrections department may also disclose the city and five-digit zip code of the offender's residence on release unless that would create a safety risk. All identifying information about the victim and the victim's request is private data accessible only to the victim.

Practical Notes
To receive these notices, the victim must submit a written (or, for the Department of Corrections, electronic) request in advance; notice is not automatic. The rights include advance notice of release or custody changes, expungement petitions, end-of-confinement review (with a right to submit written input), escape and recapture, apology letters, and limited offender-location information. Victim request and notice information is classified as private data and is accessible only to the victim. “Crime against the person” for this section means a crime listed in section 611A.031.
