§ 626.18 — Search Warrants Relating to Electronic Communication Services and Remote Computing Services

Plain-Language Summary

This section sets rules for search warrants seeking records from companies that provide electronic communication services or remote computing services, such as email providers and cloud storage companies. A foreign corporation properly served with a Minnesota warrant must generally produce the requested records within eight business days, though a judge may require faster production if delay would cause an adverse result, or may extend the deadline for good cause. The records sought can include customer identity, stored data, service usage, the recipients of communications, and the content of communications. The corporation must verify the records are authentic, may move to quash the warrant, and is granted immunity for complying.

Practical Notes
This applies to law enforcement seeking digital records from service providers. If you operate such a provider and receive a warrant, you generally have eight business days to produce the records and can move to quash within that period.
