§ 62Q.56 — Continuity of Care

Plain-Language Summary

This section protects continuity of care when a health plan's contract with a provider ends or when an enrollee changes health plans. The plan must give affected enrollees written notice (at least 30 days before a provider termination when it had at least 120 days' notice) and let qualifying enrollees keep seeing their current provider for up to 120 days for conditions like an acute condition, a serious illness, pregnancy, or a disability. Coverage with the current provider can continue for the rest of the enrollee's life if a physician certifies an expected lifetime of 180 days or less. These protections apply only if the provider accepts the plan's in-network payment terms and preauthorization rules.

Practical Notes
When a health plan ends its contract with a primary care provider, specialist, or hospital (including nonrenewal), or when an enrollee switches plans, the plan must notify affected enrollees and, on request, authorize continued care with their existing provider for up to 120 days (or for life if the enrollee has 180 days or less to live). The provider must accept the plan’s reimbursement and preauthorization requirements for these protections to apply.
