§ 84.0272 — Procedure in Acquiring Lands

This section sets the procedure the DNR commissioner must follow when acquiring land or interests in land, starting with a fact sheet and a sworn appraisal. The commissioner may pay less than the appraised value but not more than ten percent above it. For permanent stream easements, the commissioner may instead pay a onetime amount equal to $5 per linear foot of stream plus the corridor acres times an estimated market value. For land worth less than $100,000 the commissioner may skip the appraisal and set value from county assessment or comparable sales, and for land worth less than $1,000 may add a transaction incentive as long as the total stays at or below $1,000.
