§ 1.26 — Enemy Attack, Temporary Relocation of Seats of Government

Plain-Language Summary

If an enemy attack or threatened attack makes it impossible to run government from its normal location, the governor can temporarily move the state capital to another place. Local governments can also relocate their operations during such emergencies. All official acts done at the temporary location are just as valid as if done at the regular location.

Practical Notes
This Cold War-era provision ensures government continuity during a catastrophic attack. The governor’s emergency relocation power overrides any conflicting laws, charters, or ordinances. Local governments can move operations outside their normal boundaries during such emergencies.
