§ 103D.535 — Appellate Procedures and Review

Plain-Language Summary

This section explains how to appeal project-related orders from watershed district managers. You can appeal to district court or the board within 30 days. Appeals can challenge the amount of benefits or damages, fees, or the decision to approve or deny a project. Appeals are tried by jury or the board and take priority over other civil matters.

Practical Notes
You must file a notice of appeal within 30 days of the final order and post a bond of at least $250. Permit decisions and rule enforcement actions cannot be appealed under this section (use section 103D.537 instead). Metropolitan-area projects under approved surface water plans are also not appealable here. The court can refer technical questions to the board.
