§ 103D.625 — Drainage Systems in Watershed District

Plain-Language Summary

This section explains how county and joint county drainage systems are transferred to watershed districts. The transfer can be started by the drainage authority, an interested person, or the managers. A public hearing is required before the transfer. Once transferred, the drainage system becomes part of the watershed district's works.

Practical Notes
After a drainage system is transferred, repairs and maintenance must follow Chapter 103E procedures unless the alternative power under section 103D.621 is used. New drainage construction in the district also requires a petition and must follow Chapter 103E. A two-week published notice and public hearing are required before any transfer.
