§ 103D.921 — District Court to Create Preliminary Fund

Plain-Language Summary

When a project petition is filed, managers can ask the district court to create a preliminary expense fund for initial work like surveys and planning. The court decides the fund amount and how much each affected county must contribute. The counties advance the money, which must be repaid with interest from project assessments.

Practical Notes
The preliminary fund is a loan from counties, not a grant. Counties must be given at least 10 days notice. If the project goes forward, preliminary expenses become part of the project cost and are repaid from assessments. State agencies and political subdivisions may also contribute based on their expected benefits.
