§ 103I.111 — Local Authority Over Wells and Borings

This section allows the Commissioner of Health to delegate well and boring inspection duties to local community health boards. Local governments cannot regulate well construction unless the commissioner delegates that authority. Local governments can regulate open wells as public nuisances and can enforce unsealed well requirements. Licensed well contractors cannot be charged local license or registration fees.

Practical Notes
Local governments generally cannot require their own permits for well construction unless they have a delegation agreement with the state. If they do have such an agreement, they can charge fees above the state rate. Unsealed wells are considered a public health nuisance and can be abated by the county. If you drill wells professionally, cities and counties cannot charge you an extra local license fee.
