§ 103I.205 — Well Construction

Plain-Language Summary

This section sets the rules for building wells in Minnesota. Before constructing most wells, you must file a notification with the Commissioner of Health and pay a fee. Licensed contractors are generally required, though individuals can build their own water-supply wells on their own farmland or home property. Wells not in use must be sealed or have a maintenance permit. The section also covers distance requirements from contamination sources, well labeling, and reporting.

Practical Notes
Before drilling a well, you must notify the commissioner and pay a filing fee. If you are an individual building a water-supply well on your own farm or home, you can do it yourself but must still notify the state within 10 days. Wells that are no longer in use need a maintenance permit or must be sealed. Completed well work must be reported within 60 days. Building a well on someone else’s property requires a written agreement about who is responsible for permits and future sealing.
