§ 115B.05 — Liability for Economic Loss, Death, Personal Injury, and Disease; Limitations and Defenses

Plain-Language Summary

This section makes responsible persons strictly liable for economic losses, property damage, death, personal injury, and disease caused by hazardous substance releases. Damages can include medical costs, lost income, and pain and suffering. Several defenses are available, including acts of God, acts of war, and releases within valid permits.

Practical Notes
This section covers personal harm, while section 115B.04 covers cleanup costs and natural resource damages. Workers’ compensation claims are excluded if the injury arose in the course of employment. Political subdivisions have liability caps. Anyone claiming a defense must prove it by a preponderance of the evidence. There is no liability for pollutants or contaminants under this section, only for hazardous substances.
