2025 Session Last amended: 2004 session

§ 115B.16 — Disposition of Facilities

Plain-Language Summary

This section controls what happens to property that was used for hazardous waste disposal. You cannot use the property in ways that damage the containment or monitoring systems unless the agency approves. Before selling contaminated property, the owner must record an affidavit with the county recorder disclosing the contamination. Violations can result in fines up to $100,000.

Practical Notes
If you are buying property, a title search should reveal any recorded affidavits about hazardous waste. Sellers who fail to record the required affidavit can face both fines and full liability for any resulting contamination. The affidavit requirement does not prevent a sale from going through, but it does put buyers on notice. Fines collected go into the remediation fund.
