§ 115B.178 — Association With Release; Commissioner's Determination

Plain-Language Summary

The commissioner can issue written determinations that certain actions taken on contaminated property will not make the person liable for the existing contamination. This applies to both future planned actions and actions already taken in the past. The determination may include conditions the person must follow.

Practical Notes
This section is valuable for developers and lenders who want certainty that improving or lending on contaminated property will not expose them to environmental liability. For past actions, you must disclose fully what you did and conduct an approved investigation. The determination can extend to future owners. This works together with sections 115B.175 and 115B.177 to encourage productive use of contaminated sites.
