§ 115B.26 — Paying Claims

Plain-Language Summary

This section explains how compensation claims under the environmental claims program are paid. The legislature must directly appropriate money from the remediation fund to pay approved claims. For claims related to petroleum releases, the agency requests a transfer from the petroleum tank release cleanup fund to cover those payments.

Practical Notes
Approved claims are not paid automatically. The agency must submit them to the legislature for appropriation, which means there can be a delay between when a claim is granted and when it is actually paid. Petroleum-related claims are funded through a separate mechanism involving the petroleum tank fund.
