§ 115C.08 — Petroleum Tank Fund

Plain-Language Summary

The Pollution Control Agency can take emergency action to clean up petroleum releases that pose an immediate threat to health or the environment. The costs of emergency cleanup are recoverable from the responsible person.

Practical Notes
If a petroleum spill creates an immediate danger, the state can step in and clean it up right away without waiting for the responsible person to act. The responsible person must then reimburse the state for the emergency cleanup costs.
