Plain-Language Summary

If the government needs your property before the condemnation process is finished, it must give you at least 90 days notice by certified mail and pay you the appraised value upfront. After commissioners file their award, the government gets possession when it pays the award or deposits three-fourths of it with the court.

Practical Notes
You are entitled to 90 days notice before the government takes possession of your property. The government must pay its appraised value before taking possession. If more than $10,000 is deposited with the court, it must be placed in an interest-bearing account within 5 business days, and you receive the interest.
