§ 117.155 — Payments; Partial Payment Pending Appeal

Plain-Language Summary

While an appeal is pending, property owners can demand a partial payment of up to three-fourths of the commissioners' award. The government must promptly pay this amount. Once paid or deposited, partial payments do not earn interest. If the final award is less than what was already paid, the owner must return the difference.

Practical Notes
If the government appeals the award, you can demand up to 75% of the commissioners’ award as a partial payment while you wait for the appeal to be decided. This can help cover moving costs and other expenses. Be aware that if the final award is lower, you may need to return the difference.
