§ 129D.17 — Arts and Cultural Heritage Fund

Plain-Language Summary

This section governs the Arts and Cultural Heritage Fund established in the Minnesota Constitution. Money from this fund may only be spent on arts, arts education, arts access, and preserving Minnesota's history and cultural heritage, and only for projects in Minnesota. At least 47% of the fund's biennial appropriations must go through the Minnesota State Arts Board or regional arts councils. A 5% reserve must be maintained each year. Large projects of $10 million or more require attorney general review of contracts and real estate transactions.

Practical Notes
Recipients of arts and cultural heritage fund money must report measurable outcomes, post a legacy logo on their website, and satisfy reporting requirements through the Legislative Coordinating Commission website. Non-compliance discovered by the legislative auditor results in being placed on a public list that bars future funding until compliance is demonstrated. Organizations receiving $10 million or more must also submit any contracts or real estate deals to the attorney general.
