§ 13A.03 — Delayed Notice

A court can delay the requirement to notify a bank customer that the government accessed their financial records. The government must show that notification could endanger someone's life, cause flight from prosecution, lead to destruction of evidence, intimidate witnesses, or seriously harm an investigation.

Practical Notes
If law enforcement obtains your bank records, they normally must tell you. But a judge can delay that notice if telling you right away would interfere with the investigation. The delay order must be renewed every 90 days and cannot last more than a year total.
