§ 13A.02 — Access to Financial Records by Government Authorities Prohibited

Plain-Language Summary

Government authorities cannot access your financial records from a bank or other financial institution unless you authorize it, or they have a search warrant, judicial subpoena, or other legal authorization. This law protects the privacy of bank customers from government snooping without proper legal process.

Practical Notes
Your bank records are protected from government access without your consent or a court order. There are exceptions for investigating financial exploitation of vulnerable adults and certain statutory provisions. The government must generally notify you when it accesses your records.
