§ 14.02 — Definitions

Plain-Language Summary

This section defines the key terms used throughout the Administrative Procedure Act. An 'agency' is a state body with statewide authority to make rules or decide contested cases. A 'contested case' is a hearing where someone's legal rights are at stake. A 'rule' is a general statement by an agency about how it will carry out the law.

Practical Notes
Understanding these definitions is important if you are dealing with a state agency. Courts and the Tax Court are not covered by this law. The Department of Corrections inmate hearings are also excluded from the contested case definition. If an agency action affects your rights and requires a hearing by law, it is a contested case with formal procedural protections.
