§ 14.056 — Rule Variances; Procedures

Plain-Language Summary

This section explains how to ask a state agency for a variance from its rules. Your petition must include your name and address, which rule you want a variance from, why you need it, and who else might be affected. The agency can charge a fee of $10 or more. The agency must respond within 60 days, or the petition is automatically approved.

Practical Notes
When filing a variance petition, include a signed statement that the facts you present are true. The minimum fee is $10 and is not refundable. If the agency does not respond within 60 days, your petition is automatically approved. The agency must keep records of all variance decisions and make them available to the public.
