§ 14.128 — Effective Date for Rules Requiring Local Implementation

Plain-Language Summary

If a state agency rule would require a local government to change its ordinances or regulations, the rule cannot take effect until the next January 1 or July 1 after it is adopted. This gives local governments time to update their own rules. Exceptions apply for federally required rules and when the governor issues a waiver.

Practical Notes
Local governments (towns, counties, and cities) benefit from this delay, which gives them time to update their ordinances before a new state rule takes effect. The administrative law judge reviews whether the agency correctly determined if local changes are needed. Emergency and expedited rules are exempt from this delay requirement.
