§ 14.389 — Expedited Process

Plain-Language Summary

The expedited process allows agencies to adopt rules more quickly when the legislature specifically authorizes it. The agency publishes notice, allows 30 days for public comment, and submits the rule for legal review. If the law references subdivision 5, a hearing is required if 50 or more people request one. The rule takes effect upon publication in the State Register.

Practical Notes
Watch for laws that authorize expedited rulemaking, as the comment period is shorter (30 days) and there is no automatic hearing requirement unless the law specifically references subdivision 5, which requires 50 hearing requests rather than the usual 25. The rule still must pass legal review by an administrative law judge.
