§ 14.131 — Statement of Need and Reasonableness

Plain-Language Summary

Before proposing a rule, an agency must prepare a detailed statement explaining why the rule is needed and reasonable. This statement must cover who will be affected, how much the rule will cost, whether cheaper alternatives exist, how the rule compares to federal regulations, and the cumulative effect of the rule combined with other regulations.

Practical Notes
The Statement of Need and Reasonableness is a key document you can review to understand why an agency is proposing a rule. It must be available for public review and sent to the Legislative Reference Library. The agency must also consult with the commissioner of management and budget about the fiscal impact on local governments. This statement is one of the main tools for holding agencies accountable.
