§ 142A.12 — Limits on Receiving Public Funds

Plain-Language Summary

This section stops providers, vendors, or individuals who have been excluded from one state program from participating in other programs run by the commissioner. The commissioner can also block related businesses and people connected to the excluded party. Payments can be withheld if there is a credible allegation of fraud.

Practical Notes
If you are excluded from any state or federal program, you could be banned from all programs the commissioner runs. You must receive written notice within five days and have 30 days to file an appeal for a contested case hearing. Payment withholding during fraud investigations is temporary and can be challenged through administrative reconsideration.
