§ 142B.171 — Child Care Weighted Risk System

Plain-Language Summary

This section requires the commissioner to create a weighted risk system that ranks child care violations by how serious they are. For low-risk violations, the commissioner gives technical assistance instead of a correction order. The technical assistance must explain the violation, cite the rule, and suggest how to fix it.

Practical Notes
Under this system, not every violation will result in a correction order. Low-risk violations that do not endanger anyone and were not cited at the last inspection will be handled with documented technical assistance. This gives providers guidance on how to fix problems without a formal enforcement action on their record.
