§ 142B.16 — Correction Order and Conditional License

Plain-Language Summary

This section allows the commissioner to issue a correction order or make a license conditional when a child care or foster care program breaks a rule but the violation does not put anyone in immediate danger. The order must explain what was violated, what law or rule applies, and how long the provider has to fix it. Providers can ask for the order to be reconsidered.

Practical Notes
If you receive a correction order, you have 20 calendar days to ask for reconsideration. Family child care providers can request expedited review if fixing the violation would cost a lot of money. Conditional licenses and correction orders must be posted where parents and visitors can see them for two years. Quotas for issuing correction orders are prohibited.
