§ 142G.45 — Fair Hearings

Plain-Language Summary

If you disagree with a decision about your MFIP case, such as a benefit reduction, denial, or sanction, you have the right to request a fair hearing. You must submit your request in writing within 30 days of receiving the notice, or within 90 days if you have good cause for the delay.

Practical Notes
If you request a hearing before the effective date of the adverse action (or within 10 days of the notice), your benefits continue until the hearing decision is made. The county must pay your reasonable expenses for attending the hearing, such as child care and transportation. The hearing can be held by phone or at an accessible location.
