§ 144G.12 — Application for Licensure

Plain-Language Summary

Anyone applying for an assisted living facility license must submit a detailed application to the Department of Health that includes facility ownership information, background study results for owners and managers, proof of workers' compensation and liability insurance, organizational charts, and criminal history disclosures for all persons with significant ownership or management roles. There are fees for initial applications and renewals, and late fees for tardy renewals. Operating after license expiration costs $250 per day.

Practical Notes
If you are applying to open an assisted living facility, start the application process well before your planned opening date, because the review process takes time. Gather background study results for all owners and managers and for anyone with five percent or more ownership. Make sure your liability insurance is in place before applying. A renewal application submitted less than 30 days before the license expires (or after it expires) carries a $200 penalty, and operating after expiration costs $250 for each day until the renewal license is issued, plus possible misdemeanor charges, so renew well before the expiration date.
