§ 144G.42 — Business Operation

Plain-Language Summary

Assisted living facilities must display their license at the main entrance and provide a copy to anyone who requests it. Facilities must conduct ongoing quality management reviews of services, complaints, and incidents. Facilities cannot accept power-of-attorney, serve as guardians, borrow resident funds or property, or otherwise manage residents' financial affairs beyond basic household budgeting help. Staff cannot accept significant gifts from residents.

Practical Notes
If an assisted living facility staff member or the facility itself asks you to name them as your power-of-attorney or financial manager, that is illegal. Staff cannot borrow your money or property. The facility can only help with basic household budgeting. If you see the facility’s license is expired or missing from the entrance, that is a sign to contact the Department of Health immediately.
