§ 147.092 — Probable Cause Hearing; Sexual Misconduct

Plain-Language Summary

When a doctor is charged with sexual misconduct with a patient, a special probable cause hearing is held before an administrative law judge. The hearing must happen within 30 days of a request. If probable cause is found, the charges and facts become public. If no probable cause is found, the case is dismissed, but the board can reopen the investigation later.

Practical Notes
The probable cause standard requires only a preponderance of the evidence. The hearing is closed to the public, but if probable cause is found, the charges and supporting facts become public data. A physician facing these charges must request the hearing within 20 days of the contested case filing or the allegations automatically become public.
