§ 147.091 — Grounds for Disciplinary Action

This section lists all the reasons the Board of Medical Practice can discipline a doctor or refuse to grant a license. Grounds include fraud, felony conviction, incompetent practice, sexual misconduct with patients, drug addiction, false advertising, fee splitting, improper prescribing, and failure to keep proper medical records. A license is automatically revoked for felony sexual conduct convictions. The board can temporarily suspend a license without a hearing if public safety is at risk.

Practical Notes
This is one of the most important sections for practicing physicians. The board does not need to prove actual patient injury for many violations. Physicians must maintain current addresses with the board, report delinquent taxes, and cooperate with investigations. The board generally has a seven-year statute of limitations on investigations, except for sexual misconduct cases which have no time limit. Physicians who owe more than $500 in delinquent state taxes cannot renew their license until they obtain a tax clearance certificate.
