§ 147.111 — Reporting Obligations

This section requires hospitals, clinics, medical societies, insurance companies, courts, and other health professionals to report physician misconduct to the Board of Medical Practice. Doctors must also report their own misconduct. Reports must be filed within 30 days. Failure to report can result in civil penalties.

Practical Notes
Reporting obligations are mandatory, not optional. Hospitals must report any restriction of a physician’s privileges, any denial of privileges, and any resignation during or before disciplinary proceedings. Insurers must report malpractice settlements and awards quarterly. Physicians have a self-reporting duty for any action that would trigger reporting by others. The exception is when a physician treats another physician as a patient and successfully counsels them to limit practice.
