§ 148E.265 — Adversarial but Nondisciplinary Actions

Plain-Language Summary

This section describes the nondisciplinary adversarial tools the board can use. A social worker's license is automatically suspended if a court appoints a guardian for them or commits them under mental health law. The board can issue cease-and-desist orders to stop unauthorized practice, and can seek court injunctions to stop ongoing violations. These actions are public but are not considered formal discipline.

Practical Notes
Automatic suspensions due to court proceedings happen by operation of law—no board hearing is required first. Cease-and-desist orders must be challenged quickly, within 15 days, or they become final. The board does not have to prove irreparable harm to get an injunction—a lower standard than typical civil cases. Cease-and-desist orders do not prevent the board from also pursuing criminal prosecution or formal discipline.
