§ 149A.04 — Enforcement

The regulatory agency can inspect funeral establishments at least every two years and whenever it suspects a violation. Inspectors can examine records, enter property, issue subpoenas, and take testimony under oath. Complaint data is kept confidential during active investigations.

Inspections are usually unannounced. If you file a complaint, your identity is kept confidential while the investigation is active and private once it becomes inactive. Funeral providers must allow access to their records and premises during inspections.
