2025 Session Last amended: 2010 session

§ 149A.80 — Death; Right to Control and Duty of Disposition

Plain-Language Summary

A person can leave written instructions about their funeral wishes. If no instructions exist, the right to decide follows a specific order: a named designee, then spouse, then adult children, then parents, then siblings, then grandchildren, then a guardian, and finally anyone willing to take responsibility.

Practical Notes
Having written advance directives about your funeral wishes is strongly recommended. Without them, disputes among family members about final disposition can lead to court proceedings. A health care directive can also name someone to handle funeral arrangements.
