2025 Session Last amended: 2023 session

§ 152.18 — Discharge and Dismissal

Plain-Language Summary

Allows courts to defer prosecution and dismiss drug possession charges for eligible first-time offenders without a conviction on their record. Applies to third-, fourth-, and fifth-degree possession crimes. For fifth-degree offenders meeting all criteria, the stay of adjudication is mandatory. Also provides for expungement of certain old marijuana convictions.

Practical Notes
This is one of the most important statutes for anyone facing a first-time drug possession charge. If you qualify, the court places you on probation without entering a conviction. If you complete probation successfully, the case is dismissed and the record is sealed (not public). This can protect your employment, housing, and education prospects. Ask your attorney or public defender whether you are eligible for a 152.18 stay.
