§ 161.3209 — Construction Manager/general Contractor; Procedures

Plain-Language Summary

This section sets out the two-phase process for selecting a Construction Manager/General Contractor for a highway project. In Phase 1, firms submit qualifications and proposals evaluated by a technical review committee. In Phase 2, the commissioner negotiates a construction contract with the top-ranked firm, which must self-perform at least 30 percent of the work. If negotiations fail, the commissioner can use another procurement method.

Practical Notes
The CMGC selection process involves evaluating qualifications and negotiating a guaranteed maximum price. Contractors interested in CMGC work should follow the specific procedures in this section.
