§ 161.3420 — Design-build Rfq; Selection Team; Evaluation

Plain-Language Summary

Phase one of the design-build selection process uses a Request for Qualifications (RFQ) to screen and short-list up to five qualified design-build firms. A Technical Review Committee of at least five members — including an industry representative from the Associated General Contractors — evaluates the responses. Committee members with any financial interest in a responding firm must step aside from that review.

Practical Notes
The RFQ must include minimum qualifications, project scope, and selection criteria with assigned weights. The short list is limited to two to five firms. Committee members are treated as state employees if sued based on their committee work, which provides important liability protection for industry appointees who serve on the committee.
