§ 164.08 — Cartways

Plain-Language Summary

This section governs cartways, which are narrow roads giving access to landlocked property. A town board may create a two-rod-wide cartway on a section line when five voters petition for it. A town board must create a cartway for any landowner who has at least five acres with no road access.

Practical Notes
If you own at least five acres of landlocked property, the town board is required to establish a cartway to connect you to a public road. Owners of parcels of two to five acres recorded before January 1, 1998, also qualify. The petitioning landowner pays the costs. Maintenance costs are shared among all landowners who use the cartway.
